1. Acceptance of Terms

By accessing or using the Posiqo application ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service.

2. Description of Service

Posiqo is an AI-powered fitness application that uses your device camera for real-time exercise form analysis, rep counting, and workout tracking. The Service includes:

• AI Form Coaching: Real-time joint tracking and voice coaching cues using on-device AI (Google ML Kit). No camera data is transmitted.
• Rep-Level Form Replay: Per-rep breakdown with colour-coded feedback after each set.
• Rest Timers & Progressive Overload: Guided rest periods and AI-driven suggestions to increase reps or weight over time.
• Walking & Running Tracking: GPS-based cardio tracking with interval training plans, pace zones, per-km splits, cadence, and elevation.
• Health Platform Sync: Optional two-way integration with Apple Health (iOS) and Google Health Connect (Android) to read steps from wearables and write workout summaries back.
• Gamification: XP, coins, avatar progression, achievements, group challenges, and a social activity feed.
• Structured Workout Plans: Beginner to advanced plans with warm-ups and cooldowns.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 13 years old to create an account.
• One account per person. Sharing accounts is not permitted.

4. Free Trial and Subscription

• New users receive a 30-day free trial ("Trial Period") to access all features.
• Trial access includes AI pose detection and form analysis for unlimited workouts during the 30-day period.
• Walking and running features are always free, regardless of subscription status.
• Health platform sync (Apple Health / Google Health Connect) is available to all users at no charge.
• After the Trial Period, continued access to exercise features (AI pose detection, form analysis) requires a Pro subscription.
• Pro subscription is billed monthly at ₹99/month (INR) and yearly at ₹999/year (INR).
• Subscriptions are processed securely through Razorpay.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• No refunds are provided for partial billing periods.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent subscription restrictions or payment requirements
• Reverse engineer, decompile, or disassemble any part of the application
• Interfere with or disrupt the Service or its servers
• Impersonate other users or provide false information
• Use automated systems or bots to access the Service

6. Health Disclaimer

Posiqo is a fitness tracking tool and does not provide medical advice. The form analysis, coaching features, and health data integrations are for informational and motivational purposes only. Always consult a healthcare professional before starting a new exercise program. You exercise at your own risk, and Posiqo is not liable for any injuries that may occur during workouts.

When Health Sync is enabled, Posiqo reads step and activity data from Apple Health or Google Health Connect. The accuracy of this data depends on your device, wearable, and the third-party health platform. Posiqo does not guarantee the accuracy of data originating from third-party sources.

7. Intellectual Property

All content, features, and functionality of the Service — including AI models, design, logos, and software — are owned by Posiqo and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described therein.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data upon account termination.

10. Limitation of Liability

To the maximum extent permitted by law, Posiqo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or physical injury.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify users of material changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, India.
